What Consumers Should Do When Business Refuses to Refund Them
Buying a product or paying for a service should come with the expectation that the business will fulfil its obligations. However, consumers sometimes face situations where a business refuses to provide a refund even when there is a legitimate reason for one.
In Nigeria, consumer protection law provides various rights concerning returns, refunds, product quality, services, and fair dealings. Consumers should therefore know the practical steps to take when a business refuses to resolve a legitimate complaint.
- Understand Why the Refund Is Being Requested
First, identify exactly why you are requesting a refund. Common situations include:
- A product is defective or damaged.
- The product delivered is different from what was ordered.
- A service paid for was not provided.
- A business failed to deliver within the agreed terms.
- You were charged incorrectly.
- The product or service was misrepresented.
- An advance booking or order was cancelled under circumstances where a refund is applicable.
The reason for the refund can affect what remedy is available.
- Check the Business’s Refund or Return Policy
Review the receipt, invoice, contract, warranty, website, or other terms provided when you made the purchase.
However, a business policy does not automatically override statutory consumer rights. The FCCPC states that Nigerian consumers have rights concerning the return of goods in appropriate circumstances, while certain advance bookings or orders may also attract refund rights subject to applicable conditions.
- Keep Your Evidence
Do not throw away documents relating to the transaction.
Keep:
- Receipts and invoices
- Payment confirmations
- Contracts or agreements
- Warranty documents
- Product photographs
- Screenshots of advertisements
- Emails and text messages
- WhatsApp conversations
- Previous correspondence with the business
The FCCPC specifically advises consumers submitting complaints to attach relevant documents such as receipts, agreements, and correspondence.
- Contact the Business in Writing
Give the business an opportunity to resolve the matter.
Clearly explain:
What you purchased → what went wrong → when you complained → why you are requesting a refund → the resolution you want.
Written communication is useful because it creates a record of your complaint and the business’s response.
- Ask for an Alternative Remedy Where Appropriate
A refund may not always be the only possible remedy. Depending on the circumstances, consumers may seek an appropriate solution such as:
- Repair
- Replacement
- Refund
- Correction of an incorrect charge
- Completion of an agreed service
The FCCPC has also advised businesses that, where a product or service is bad, they should be willing to repair, replace, or refund as appropriate.
- Escalate the Complaint
If frontline customer service does not resolve the issue, ask to speak with a manager, complaints department, or another responsible officer.
Give the business a reasonable opportunity to respond and keep records of every interaction.
- Report the Matter to the Appropriate Authority
If the business continues to refuse a legitimate remedy, a consumer can escalate the matter.
Under the Federal Competition and Consumer Protection Act, a consumer may refer a dispute to the business, the applicable industry regulator, or the FCCPC. The Act also provides for seeking redress through a court with appropriate jurisdiction.
The FCCPC currently provides an online complaint process through which consumers can submit complaints and supporting documents. A tracking code is generated after submission so that consumers can monitor the complaint. Complaints can also be submitted through other channels, including email, letters, and walk-in submissions.
- Be Clear and Honest When Making a Complaint
When reporting a business, provide accurate information about what happened.
Avoid exaggerating the situation or making claims that you cannot support. A clear timeline and reliable evidence can make it easier for the relevant authority to understand and assess the complaint.
- Don’t Be Intimidated by a “No Refund” Statement
Consumers should not assume that a sign or statement saying “No Refund” automatically settles every dispute.
The legal position depends on the circumstances and applicable consumer-protection rules. For example, the FCCPC has reported a 2025 court decision concerning a “no refund” policy in which the court found the policy unlawful in the circumstances of that case.
This does not mean every purchase automatically qualifies for a refund; consumers should consider the specific facts and applicable law.
- Consider Legal Advice for Serious Disputes
If the amount involved is substantial or the dispute remains unresolved after appropriate complaint channels have been used, a consumer may consider obtaining legal advice about available remedies.
The FCCPA expressly preserves a consumer’s ability to approach a court with appropriate jurisdiction for redress.
Conclusion
When a business refuses to refund a consumer, the best approach is to remain calm, understand the reason for the refund request, check the applicable terms, preserve evidence, complain to the business in writing, and escalate the matter through the appropriate regulatory or legal channel when necessary.
Consumer awareness is important because businesses are expected to deal fairly with consumers, while consumers also have a responsibility to keep records, provide accurate information, and raise legitimate complaints.
Knowing your rights is the first step toward protecting yourself as a consumer.
